1. Introduction and Acceptance

Welcome to LabClarity, a product of StableState LLC ("Company," "we," "us," or "our"). By accessing or using LabClarity at labclarityai.com or any associated applications (collectively, the "Service"), you agree to be bound by this Privacy Policy and Terms of Service (this "Agreement"). If you do not agree to all terms, you must not use the Service.

This Agreement constitutes a legally binding contract between you and StableState LLC. We reserve the right to modify this Agreement at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.

3. Description of Service

LabClarity is an AI-powered tool that helps users understand their blood test and laboratory results in plain English. Users upload images, PDFs, or text of their lab results, which are analyzed by Claude AI (developed by Anthropic) to produce structured, easy-to-understand summaries.

4. Important Medical Disclaimer

LabClarity is NOT a medical device, diagnostic tool, or healthcare provider. The Service does not provide medical advice, diagnosis, or treatment. All information provided by the Service is for general informational and educational purposes only.

You should not rely on any information from the Service as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information obtained through the Service.

If you think you may have a medical emergency, call your doctor, go to the emergency department, or call emergency services immediately. StableState LLC does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned through the Service.

5. HIPAA and Protected Health Information (PHI)

StableState LLC is not a Covered Entity or Business Associate under the Health Insurance Portability and Accountability Act (HIPAA). The Service is a direct-to-consumer tool and does not access, process, or store data from healthcare providers, health plans, or healthcare clearinghouses.

While we are not subject to HIPAA, we are deeply committed to protecting your privacy and treating your health information with the highest level of care. We implement security measures that align with industry best practices for handling sensitive personal information.

6. Data Collection and Use

We collect the following information:

• Account information: Email address and display name provided through Microsoft Entra authentication, used solely for account access and session management.
• Usage data: Anonymous, aggregated analytics including number of analyses performed and feature usage patterns. This data cannot be linked to individual users or their health information.

We do NOT collect, store, retain, or have access to:

• Your lab results, images, PDFs, or text you submit for analysis
• The AI-generated analysis or summary of your results
• Any health or medical information beyond the duration of a single analysis request

7. Data Processing and Retention

Lab result data is transmitted directly from your browser to our secure API, which forwards it to Claude AI (by Anthropic) for analysis. The analysis response is returned directly to your browser. At no point is your lab data persisted on our servers, written to a database, or stored in any file system.

Per Anthropic's API Terms of Service, data submitted through their API is not used to train, improve, or develop their AI models. Data is processed only for the purpose of generating a response and is subject to Anthropic's data retention and security policies.

8. Third-Party Services

The Service relies on the following third-party providers:

• Microsoft Entra External ID: Authentication and identity management
• Anthropic (Claude AI): Lab result analysis and natural language processing
• Microsoft Azure: Cloud hosting, serverless compute, and content delivery

Each provider maintains its own privacy policy and terms of service. We encourage you to review them. StableState LLC is not responsible for the privacy practices of third-party services.

9. Security Measures

We implement the following security measures to protect your information:

• All data transmission uses HTTPS/TLS 1.3 encryption
• Authentication tokens are validated using industry-standard JWT verification with JWKS key rotation
• API keys are stored in Azure Key Vault with managed identity access
• Rate limiting is enforced to prevent abuse
• No lab data is persisted to disk, database, or logs at any point
• Cross-origin request protections (CORS) are enforced

10. Data Breach Notification

In the unlikely event of a security breach that affects your personal information, we will notify affected users via email within 72 hours of becoming aware of the breach. We will also notify relevant regulatory authorities as required by applicable law.

11. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You must be at least 18 years of age to create an account and use the Service.

12. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload content that is fraudulent, misleading, or not genuine lab results
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Attempt to bypass rate limits, authentication, or other security measures
• Use the Service to build a competing product or service
• Share your account credentials with others or allow unauthorized access
• Submit lab results belonging to another person without their explicit consent

13. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, design, and software, are the exclusive property of StableState LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

The LabClarity name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of StableState LLC. You may not use these marks without the prior written permission of StableState LLC.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STABLESTATE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any information obtained from the Service, including but not limited to AI-generated lab result summaries
• Any medical decisions made based on information provided by the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to StableState LLC in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.

15. Indemnification

You agree to defend, indemnify, and hold harmless StableState LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement, your use of the Service, or your violation of any rights of a third party.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. StableState LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from use of the Service will be accurate, reliable, or meet your requirements.

17. Children's Privacy (COPPA)

The Service is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly. If you believe a child under 18 has provided us with personal information, please contact us at contact@stablestateit.com.

18. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates this Agreement, is harmful to other users, or is otherwise objectionable. You may delete your account at any time by contacting us at contact@stablestateit.com. Since we do not store lab results, there is no lab data to delete upon account termination.

19. Dispute Resolution and Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to this Agreement or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against StableState LLC.

20. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

21. Entire Agreement

This Agreement constitutes the entire agreement between you and StableState LLC regarding use of the Service and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
